On Thursday 12 February 2026 a writ authorising the NT Electoral Commission to conduct a by-election for the division of Nightcliff was issued by the Administrator.
The writ set 19 February 2026 as nomination day, Saturday 7 March as election day and Monday 13 April as the last day on which the writ may be returned.
A by-election was duly held with the following results.
Four candidates contested the division of Nightcliff and the first preference votes recorded for each candidate were as follows:

Under the preferential voting system, the quota of votes required to be elected for this election was 1,914.
As the quota was not achieved by any candidate on first preference votes, a distribution of preferences was conducted in accordance with section 128 of the Electoral Act 2004.
As a result, candidate Ed SMELT (Australian Labor Party NT Branch) achieved the quota at count 3.
It was therefore declared on this day, 23 March 2026 at 10am, Ed SMELT duly elected to the division of Nightcliff.

Counting of the final intake of postal votes is conducted today, as well as the full distribution of preferences. The count results are published at the conclusion of the count and the Declaration of Result will take place at 10am on Monday 23 March.

Following yesterday’s combined count, which saw the second intake of postal votes and accepted declaration votes counted there are now 107 potential postal votes remaining. Formal postal votes received between now and midday on Friday 20 March will be added to the count.
At yesterday’s count there were 103 postal votes and 58 accepted declaration votes counted.

22 postal votes remain kept back to maintain the secrecy of the vote.
The final postal count will be conducted after midday on Friday 20 March, followed by the full distribution of preferences. The results will be published at the conclusion of the count and the result declared at 10am on Monday 23 March.

A combined count will take place today. The combined count involves the counting of the second intake of postal votes and of admitted declaration votes.
The count is being conducted at the NTEC Scrutiny Centre (Level 3, TCG Centre, 80 Mitchell Street, Darwin CBD) from 9am.
Results will be published on the results page at the conclusion of the count.
There will be one (1) count table. As such, each candidate is entitled to one (1) scrutineer. Scrutineers are required to arrive at 8:45am.
Scrutineers attending the NTEC Scrutiny Centre for the first time must ensure they bring their scrutineer appointment form with them.

There have been 110 postal votes returned and admitted to the count since election day counting, noting this includes 19 postal votes kept back and not counted on election night. 160 postal votes have been counted to date.
There remain around 120 postal votes that may still be returned by the deadline, 12 noon, Friday 20 March 2026.
Postal Vote 2 count is scheduled for Tuesday 17 March 2026.
The final result will be declared on Monday 23 March 2026.

At the close of the early voting centre at 6pm on Friday 6 March, 2621 votes had been cast across the early voting period. 32 votes were cast through mobile voting services, and 441 postal votes had been issued.

On Saturday 7 March, 907 votes were cast at the Election Day Voting Centre.
Of the 5941 electors in the Division of Nightcliff, 3720 cast votes, which equates to a 62.6% participation rate.
